Service Agreement and Liability Waiver

1. Parties and Services

   I, the client identified in my completed Client & Dog Profile (the "Releasing Party"), am enrolling myself and each dog for which I have provided a Client & Dog Profile (each, "my dog") in Services offered by Dogs With Jules, LLC (the "Released Party"). The Services include any training, consultation, class, workshop, club session, day school, boarding, or related activity provided by Dogs With Jules, whether at the Releasing Party’s home, at a public location, or at the premises of Dogs With Jules. 

2. Representations

   I represent that all information I have provided about my dog including bite history, reactivity, resource guarding, medical conditions, microchip and vaccination status is truthful and complete to the best of my knowledge. I agree to notify Dogs With Jules promptly of any change, including any bite or injury incident that occurs outside of the Services. I understand that animal behavior is not fully predictable and that no specific training outcome, timeline, or result is guaranteed.

3. Assumption of Risk and Release

   By agreeing to partake in the Services, I certify that I have been informed and understand that there is always some unavoidable risk of injury involved when working with animals, especially animals with behavioral issues. I acknowledge that dogs can be inherently difficult to control and that not all dogs will be under control at all times resulting in the possibility of injury to myself, my dog, my family members, or third parties. Additionally, I have had full opportunity to discuss all concerns I have about the foregoing risks with Dogs With Jules and its authorized representatives. I have also made all inquiries and investigations to my satisfaction related to such risks, including, but not limited to, an examination of the training area (if applicable). I hereby accept and assume, without reservation, all risks associated with my or my dog’s participation in the Services, including, but not limited to: the risks of any and all injuries to myself, my dog and any of my family members or third parties who may attend; the risks that my dog may cause injury to other persons and/or dogs while training. 

   As lawful consideration for my or my dog's participating in the Services, I, for myself, my heirs, executors, administrators, legal representatives, successors and assigns hereby waive, release, discharge and agree not to sue and to indemnify, defend and hold harmless Dogs With Jules and their members, managers, agents, and employees from any and all injuries, losses, claims and damages to any person or persons of any nature whatsoever, and all costs associated therewith, including attorney’s fees, court costs and consultant fees, arising from my or my dog’s participation in the Services.

   This release does not apply to claims arising from gross negligence, recklessness, or willful misconduct on the part of Dogs With Jules, or to any liability that may not be released as a matter of law.

4. Payment

   I understand that my payment card information is processed and stored by Stripe, Dogs With Jules’ payment processor. Dogs With Jules does not store or have access to full card numbers.

   By providing a payment method, I authorize Dogs With Jules to charge it for:
   - the deposit and balance of any service I book;
   - recurring monthly membership fees for club enrollment, billed in advance of the first session each month, until I cancel;
   - late cancellation or no-show fees as described in the Cancellation Policy;
   - emergency veterinary costs advanced on my dog's behalf, and any documented property damage caused by my dog.

   I will be notified before any charge outside the scheduled price of a booked service. If I have a question about a charge, I agree to contact Dogs With Jules first so it can be resolved directly.

   If my dog requires veterinary attention while in the care of Dogs With Jules and I cannot be reached, I authorize Dogs With Jules to seek veterinary treatment at my expense, and to transport my dog for that purpose. I will provide current contact information and a reachable emergency contact, and I will notify Dogs With Jules if either changes during the stay.

5. Cancellation Policy

   Appointments cancelled or rescheduled with less than 24 hours' notice, and no-shows, may be charged in full. Boarding and Board & Train bookings are subject to longer notice requirements stated at the time of booking. Club memberships are billed monthly in advance; unused sessions roll over for up to 30 days and are not refunded.

6. Right to Decline or Discontinue

   Dogs With Jules may decline or discontinue Services for any dog at its discretion, including for safety reasons. Unused sessions will be refunded on a pro-rated basis; deposits for boarding and Board & Train are refunded pro-rata for unused nights or sessions, less any costs already incurred.

7. General

   I am at least 18 years old. If any minor participates in the Services, I am their parent or legal guardian and agree to these terms on their behalf. This agreement is governed by the laws of the State of California, and any dispute shall be brought in the courts of San Diego County. Certain Services — including boarding, board & train, day school, and club sessions — are subject to additional written terms provided at the time of booking. Where those terms conflict with this agreement, the more specific terms govern.

   This Waiver of Liability & Informed Consent Release shall be legally binding on the Releasing Party. If the Releasing Party brings a claim contrary to the terms of this agreement, the prevailing party shall be entitled to recover reasonable attorney's fees and costs. No waiver or modification of any provision herein shall be valid unless expressly agreed to in writing by both the Released Party and the Releasing Party. Every provision herein is intended to be severable. If any one or more of the provisions herein is found to be unenforceable or invalid, that shall not affect the other terms and provisions hereof, which shall remain binding and enforceable.
